1 The Commission shall— (i) promulgate standards to be used by vendors to develop software that— (I) permits candidates to easily record information concerning receipts and disbursements required to be reported under this act at the time of the receipt or disbursement; (II) allows the information recorded under subclause (I) to be transmitted immediately to the Commission; and (III) allows the Commission to post the information on the Internet immediately upon receipt; and (ii) make a copy of software that meets the standards promulgated under clause (i) available to each person required to file a designation, statement, or report in electronic form under this Act. 3 (B) The Commission shall make a designation, statement, report, or notification that is filed with the Commission under this act available for inspection by the public in the offices of the Commission and accessible to the public on the Internet not later than 48 hours (or not later than 24 hours in the case of a designation, statement, report, or notification filed electronically) after receipt by the Commission. 4 To the extent feasible, the Commission shall require vendors to include in the software developed under the standards under subparagraph (A) the ability for any person to file any designation, statement, or report required under this act in electronic form. 5 The Commission shall— (1) prescribe forms necessary to implement this Act; (2) prepare, publish, and furnish to all persons required to file reports and statements under this act a manual recommending uniform methods of bookkeeping and reporting; (3) develop a filing, coding, and cross-indexing system consistent with the purposes of this Act. 6 Statements filed with State officers; “appropriate State” defined; duties of State officers; waiver of duplicate filing requirements for States with electronic access (a) (1) A copy of each report and statement required to be filed by any person under this act shall be filed by such person with the Secretary of State (or equivalent State officer) of the appropriate State, or, if different, the officer of such State who is charged by State law with maintaining State election campaign reports. 7 (d) Other Adjustments Made.— If a civil monetary penalty subject to a cost-of-living adjustment under this act is, during the 12 months preceding a required cost-of-living adjustment, increased by an amount greater than the amount of the adjustment required under subsection (a), the head of the agency is not required to make the costof-living adjustment for that civil monetary penalty in that year. 8 (6) Any increase under this act in a civil monetary penalty shall apply only to civil monetary penalties, including those whose associated violation predated such increase, which are assessed after the date the increase takes effect.
