2 In addition to the general solicitations permitted under subparagraph (A), an individual described in paragraph (1) may make a solicitation explicitly to obtain funds for carrying out the activities described in clauses (i) and (ii) of section 30101(20)(A) of this title, or for an entity whose principal purpose is to conduct such activities, if— (i) the solicitation is made only to individuals; and (ii) the amount solicited from any individual during any calendar year does not exceed $20,000. 3 The term “qualified State or local political organization” shall not include any organization otherwise described in subparagraph (A) if a candidate for nomination or election to Federal elective public office or an individual who holds such office— (i) controls or materially participates in the direction of the organization, (ii) solicits contributions to the organization (unless the Secretary determines that such solicitations resulted in de minimis contributions and were made without the prior knowledge and consent, whether explicit or implicit, of the organization or its officers, directors, agents, or employees), or (iii) directs, in whole or in part, disbursements by the organization (f) Exempt organization which is not political organization must include certain amounts in gross income. 4 For purposes of paragraph (1), an organization described in section 170(c) (4) shall be treated as described in section 170(c) only with respect to solicitations for contributions or gifts which are to be used exclusively for purposes referred to in section 170(c)(4). 5 If any failure to which subsection (a) applies is due to intentional disregard of the requirement of section 6113— (1) the penalty under subsection (a) for the day on which such failure occurred shall be the greater of— (A) $1,000, or (B) 50 percent of the aggregate cost of the solicitations which occurred on such day and with respect to which there was such a failure, (2) the $10,000 limitation of subsection (a) shall not apply to any penalty under subsection (a) for the day on which such failure occurred, and (3) such penalty shall not be taken into account in applying such limitation to other penalties under subsection (a).
