1 Under s 51(xxvi) of the Constitution, the Australian Parliament has the power to make laws with respect to “the people of any race for whom it is deemed necessary to make special laws.” This power might be used to create Indigenous quotas (unless this is seen by the High Court as inconsistent with the direction in ss 7 and 24 of the Constitution that Parliament be “directly chosen by the people”).
